Is paid annual leave available to domestic workers?

Domestic work is defined by the ILO’s C189 Domestic Workers Convention as work performed in or for a household or households within an employment relationship. It is estimated that over 80% of domestic workers are engaged in informal employment globally; a small number of countries extend guarantees to paid leave to “informal workers” and those countries are included in this category as well. This indicator reflects provisions in national labor and social security legislation and does not reflect provisions specific to non-citizen migrant domestic workers.

Domestic workers specifically excluded means that a country’s labor and/or social security legislation explicitly excludes domestic workers from rights and entitlements broadly, or specifically from paid annual leave. This includes countries with national guarantees to paid annual leave which only extend unpaid annual leave to domestic workers. It also includes countries with legislative loopholes that exclude workers at small enterprises (e.g. enterprises with fewer than 5 employees).

Guaranteed less generous benefit means that legislation explicitly extends annual leave to domestic workers, but fewer than the annual leave entitlement of the general workforce.

Not specifically included/excluded means that workers are guaranteed annual leave, and legislation does not explicitly guarantee nor deny coverage to domestic workers. This category also includes countries which have ratified the ILO’s Domestic Workers Convention but do not include explicit guarantees to domestic workers in their national legislation. Additionally, this category includes a limited number of cases where legislation states that future legislation or regulations will determine the extent to which existing provisions apply to domestic workers.

Guaranteed equal or more generous means that annual leave benefits are guaranteed to domestic workers and workers in general on an equal basis, or domestic workers are entitled to more annual leave than the general workforce.

To be determined by authority means that legislation does not explicitly guarantee or exempt domestic workers from annual leave entitlements, but refers to a ministry of labor or other regulatory body to establish employment standards related to annual leave.

If leave entitlements vary, we report the lowest amount of leave guaranteed to a domestic worker with at least one year of tenure.

Leave that is at the discretion of the employer is not considered a guarantee of paid annual leave.
